The U.S. Constitution, Article 1, Section 9, Clause 2:
The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

The Supremes Rescue Habeas

Any police-state action can be justified as necessary for "our safety." What I take the Supremes to be saying is security, yes, but not at the cost of illegal suspension of civil liberties.
